misuto is an independent software project operated by its developer. In these terms, “misuto,” “I,” and “me” refer to that operator. By downloading, purchasing, or using misuto or this website, you agree to these terms.
1. The service
misuto provides guided breathing, visual pacing, routines, and related general-wellness features for macOS, together with informational website content and browser-based challenges. Features may change as the product develops.
2. General wellness only
misuto is not a medical device and does not provide medical advice, diagnosis, treatment, psychotherapy, or emergency support. It is not a substitute for care from a qualified professional. Contact local emergency services if you are experiencing an emergency.
3. Use safely
Stop a breathing or visual exercise if you feel dizzy, faint, distressed, or unwell. Do not use misuto when doing so could distract you from driving, operating machinery, or another activity that requires full attention. You are responsible for deciding whether an exercise is appropriate for you and for seeking professional guidance when needed.
4. Your license
Subject to these terms and any terms shown at purchase, you receive a limited, personal, non-exclusive, non-transferable license to install and use misuto. You may not resell, redistribute, reverse engineer, or use the software to build a competing product except where applicable law expressly permits it.
5. Purchases, trials, and refunds
Prices, license duration, trial terms, taxes, and included updates are shown before purchase. Payments are handled by the checkout provider identified at checkout. Refunds are governed by the policy presented at purchase and any mandatory consumer rights that apply to you. Nothing in these terms limits rights that cannot legally be waived.
6. Acceptable use
Do not misuse the website or software, interfere with its operation, attempt unauthorized access, distribute malware, abuse brain-game sharing features, or use misuto in violation of applicable law.
7. Ownership
misuto and its original software, interface, branding, and content remain the property of the operator or relevant licensors. These terms give you permission to use the product; they do not transfer ownership of it.
8. Availability and updates
misuto is provided on an “as available” basis. I may fix, update, replace, or discontinue features. I do not promise uninterrupted availability or compatibility with every Mac, macOS release, third-party service, or configuration.
9. Warranties and liability
To the extent permitted by law, misuto is provided without implied warranties and the operator is not liable for indirect, incidental, special, or consequential loss arising from its use. Any total liability is limited to the amount you paid for misuto. These limitations do not apply where liability cannot legally be limited, including applicable consumer protections.
10. Disputes and applicable law
Before starting formal proceedings, please contact me so we can try to resolve the issue informally. The law and courts that apply depend on the operator’s legal location and any mandatory rights in your country. This policy does not impose arbitration or waive access to courts where no valid agreement exists.
11. Changes
I may update these terms when the product or legal requirements change. The date above will identify the latest version. Material changes will apply prospectively, subject to applicable law.
12. Contact
Questions about these terms can be sent through the contact page. Before commercial launch, the operator’s legal name, business address, and governing jurisdiction should also be added here where required by law.
